so you recall I told you about a lawsuit against the SB Botanic Gardens and the CEO and his wife...and I told you that no local media would cover the story because they are all pussies..well it's all true and now Judge Donna Geck has issued a tentative ruling

Nature of Proceedings: Motion: Good Faith Settlement

TENTATIVE RULING: The motion is granted.

BACKGROUND: This is a personal injury, arising from an incident which occurred near the entrance of the Santa Barbara Botanic Garden. 

In his complaint, plaintiff "xxxxx" alleged that as he was leaving the premises of the Santa Barbara Botanic Garden while walking his leashed dog “Otto,” he and Otto were attacked by two large dogs, and he was bitten and knocked to the ground when he attempted to separate his dog from the other dogs. He named as defendants the owners of the dogs, Steve Windhager and Pamme Mickelson Windhager, their dog-sitter, Paula Michal, and Santa Barbara Botanic Garden, Inc., on whose premises the attacks occurred, and of which defendant Steve Windhager is Executive Director. 

Plaintiff "xxxxxxx" sought damages for the personal injuries he sustained in the attack, and plaintiff  "xxxooo" sought damages for loss of consortium.

Such loss arises as a claim for damages when a spouse has been injured and cannot participate in sexual relations for a period of time or permanently due to the injury, or suffers from mental distress, due to a defendant's wrongdoing, which interferes with usual sexual activity.]

Defendant Santa Barbara Botanic Garden, Inc., has settled the action with plaintiffs, for payment of the amount of $20,000, and now seeks to have that settlement to be determined to have been made in good faith. 

the Botanic Garden has completely lost its focus and is now nothing more than a dog park slash beer garden

and now the Garden is on the hook for at least $20000 because of irresponsible dog owners who just happen to be the wife and  CEO of the non-profit Botanic Garden...

looks like they're gonna need some more fundraisers!
