so I hear the City of SB is planning to straighten and widen the roads around Mission Canyon to make it safer for drunk drivers to get to the wine and beer festivals up there..we're talking Mission Canyon and you better stop them...major history up there and it's just beautiful the way it is

so public TV King Ernie Salomon had Don Katich from the News-Pissed on and they gabbed about this and that..Don's big claim to investigative journalism is Peter Lance's DUI series on his own arrest...that's it...that's what Don is most proud of....Ernie asked him why the New-Piss doesn't do investigative journalism and Katich cites Peter Lance's DUI series...

and why does Katich always look like an undertaker??

but Ernie missed an opportunity to ask Don about the impending court cases against the News-Press: the wrongful termination and the wrongful death when their paper carrier ran into some jogger and killed him...will Wendy settle for $3 million like Crosby? and Ernie didn't even ask about the child porn issue at the News-Press...WTF??? I guess these idiots are more worried about the cops' pensions!

well I don't wanna rehash it more than I already have like about every other day, but Peter Lance's story was an embarrasment to investigative journalism...I mean really, investigating your own DUI arrest?? plus all the court time wasted on the pre-trial hearings...and then our old pal Judge Brian Hill tosses the case because of the search and seizure issue....like the cops didn't have a reasonable suspicion on New Year's Eve when Lance was lolligagging at a green light!!


the case presented by Darryl Genis against the cops was bogus...he claimed they routinely manipulated breathalyser tests which was totally shot down by the SB cops...

but now the Supreme Court has ruled in favor of the cops who administer breathalyzer tests

June 29 2016: Last week, the Supreme Court ruled that police officers could administer warrantless Breathalyzer tests to people suspected of driving drunk.

The case, Birchfield v. North Dakota, effectively criminalizes the refusal to submit to a Breathalyzer test and affects laws in 11 states.

The outcome will most likely lead to an increase in drunken-driving convictions across the country, according to Derek Andrews, a defense attorney at the DUI Foundation, the organization linked to the viral "silent" drunken-driving checkpoint hack.

The Fourth Amendment protects against unreasonable searches and seizures, though laws vary by state. Many lawyers openly encourage their clients to refuse a Breathalyzer because prosecutors have a harder time landing convictions with less evidence. Depending on the probable cause, refusing to take a pre-arrest Breathalyzer likely won't result in a license suspension, but in many states, like New York, refusing a post-arrest Breathalyzer could lead to automatic license suspension of varying durations.

With the Supreme Court's decision, however, there could be "an increase in the number of chemical test results," Andrews wrote in an email to Business Insider. People might be more likely to submit for fear of the certain legal repercussions. Chemical tests can be a Breathalyzer, blood draw, or even a urine sample.

To put it simply, more people submitting to Breathalyzer tests means that states and prosecutors will have greater evidence against them.

While a state should be able to ask for a warrantless Breathalyzer test, and even a blood draw, states should not be able to criminalize the refusal of the test, according to Andrews.

"It is a fundamental premise of our criminal justice system that it is the government's burden to prove beyond a reasonable doubt that someone is guilty of a crime, and it is the government's duty to collect evidence and develop a case," Andrews wrote. "It is not, however, a person's duty to give that evidence to the government."

the News-Press has been encouraging people to drink and drive becasue Nipper peddles booze, but I want to discourage people from driving drunk because I pay taxes to babysit them and I'm getting sick of it

so to the new Santa Barbara Police Chief Lori I say get that drunk driving team back up in full force...out on the streets pulling over suspected drunks..going into bars and getting the young folks to blow is not a smart program because most of the drunks on the road are in their 50s 60s and 70s..they don't care anymore!!

so I read the stories about the SOAP actress Jensen Buchanan who was allegedly drunk when she crashed her Mercedes into an oncoming car up by the Casino...also alleged is her BAC was .34...geez..her blood alcohol level was .34! that's almost a Jim Beam transfusion!

so the News-Press/Noozhawk had the stories and I didn't see Daryl's name anywhere..Jensen has two lawyers I've never heard of..and the poor gal has to wear ankle monitoring devices to make sure she doesn't drink..alcohol is very addictive and adults wearing ankle-alcohol monitoring devices would seem to indicate that

then I see David Crosby agreed to pay $3000000 to settle a lawsuit by the guy, the jogger who got hit by Crosby's Tesla... I was under the impression the sun was the cause of the accident but the story in EDHAT says the lawsuit says Crosby was drunk or high when he hit the jogger..really?

I don't get this one...there was no investigation?? highly unusual for cops not to do a DUI field test esp when someone is injured...so they just let him go until he was sued..what I can get from the Texas web is Crosby maybe lied to the police per the injured guy's attorney or the injured guy saw some rocknroll money in his future and just sued, kinda like extortion

given Pete's history of communicating thru music, I think he looks at everything to come up with a conclusion or song...that's his job..and given that he's a long-time celebrity, people are gonna believe what they want to believe....

oh, I loved the picture in the Coastal View this week with a Channel Island fox on Chuck Graham's kayak...Chuck of course was a cheerleader for the fox recovery program which resulted in killing thousands of other animals on the Channel Islands..now he's complaining that the foxes are running amok, stealing food from campers...like the monkeys in Belize!!




I hate to say I told you so and others have told you so but the foxes were not endangered in the first place and now you've taken away some good solid predators like the golden eagle and the foxes are running amok like rats! not exactly free in the wild like the island pigs and horses were..these nonprofit enviro folks suffer from group-think and can't think critically, so the little foxes outsmarted them

hahahahah..it's pretty funny until you consider the animals that got slaughtered for this folly....geez

I said before these folks should be jailed for animal abuse and certainly all the killing and now the over-population is animal abuse, but for some reason they still have their jobs..the National Parks Service and the nonprofit Nature Conservancy being the main culprits in the restorations

a serious investigation into this Channel Island mismanagement needs to be undertaken by a journalist...maybe Chuck could stop cheerleading for the NPS and Nature Conservancy long enough to investigate them....or maybe Peter Lance could do a series in the News-Press...I'd support that and it would give Pete a chance to redeem himself as an investigative journalist!

so I think about the Sherpa wildfire and the 8000 acres burned...I think about the drought, the dearth of water




so the news is about the fire and the firefighters and the horses being transported to Earl Warren Showgrounds for safety.....enough reason to keep the showgrounds just as it is ...so many important uses for this great landmark..

but when the nativists plant native plants for biodiversity, they ignore Nature..they ignore fire....fire will burn controlled or wild, but it will burn...and it will burn natives..so biodiversity is a pseudo-science

the SB Land Trust recently bought 20 acres on the Carp Bluffs for a reserve which is good..but I'm concerned they will apply the same false science of native-only and start killing beneficial weeds..the SBLT has projects on the Gaviota Coast for habitat restoration from creeks to ag lands with easements....thankfully some of these restorations are small and of no consequence except to make enviro-whackos feel good...and they use kids for the volunteer work..child labor!!

but La Sherpa ranch holds retreats, has cabins with fireplaces (uh-oh) and all sorts of activites for tourists..but does it have its own fire brigade?

so where did the fire start? at the coast and work its way inland..or inland and work its way to the coast? all those restorations went up in smoke

Last night was a perfect night....the moon was full illuminating the marsh, the wind was blowing warm and the sky was full of stars and red planets, visible to the naked eye and the clothed eye...chicks with naked eyes and naked bodies...mmmmmm!

but the moon is curious....changing colors from silver to orange over the night... it called the strawberry moon, the honey moon, the Lotus moon depending on where your head's at

and yesterday my head was at the beach and girls were mooning me...Spring was never waiting for us, girl It ran one step ahead as we followed in the dance.
 

this is a good time..I look forward to the bright orange orioles, somewhat hard to find but saw one on the outskirts of town...skirts.. ladies take your skirts off...

oh and the fennel and sage...there is nothing sweeter than fennel 'cept this gal's butt maybe...my new stupid camera wouldn't focus and I was aiming for a boat but oh nice butt cheeks!

this summer I will only search for orioles and half naked women, rare moons and soft winds...I will drink the wine while it is warm and never let you catch me looking at the sun

Montecito Menace??

then I hear there's this Indian looking guy menacing chicks in Montecito...naturally he's drunk because sober folks don't menace, they shop..and there's plenty of places to shop on Coast Village Road although no shop sells anything I would buy or consider useful...years ago when I lived there, I'd stop over at the burger joint for a sourdough burger, the best thing I've ever tasted....that was before Coast Village Road became so self-conscious and trendy... and way back when we were kids we'd go into the Coral Casino with our friends and charge big lunches to our parents, then go surf...that lasted for a few weeks...man, Montecito was so much fun then the realtors, bankers and peddlers moved in..peddler being Nipper....a head full of snow

now I was provided a link to this drunken menace dude and I swear I thought Joe Walsh gave up liquor..oh that's not Joe? well, I used to deliver the News-Press to Joe up on Park Lane back in my scuffling days..you know who else lived up there? on Buena Vista... Barbra Streisand's future husband what's his name and Burl Ives..BURL IVES!! Big Daddy! "Little Bitty Tear".... the houses were just the coolest...Burl's was a huge estate and lots of greenery and Joe's was a nice little Spanish style ranch house up on the hill yet down in a little ravine

now of course the guy who was doing the menacing was not rocker Joe Walsh... I don't know who he is but I've heard he's the village idiot and he was at a place called "Whiskey and Leather" over by the Coral Casino....I looked up some info on the store and it's boutique..another fucking boutique!! so I guess you can buy some clothes and then get drunk at the bar and even get a sandwich which for me is just too many choices....when I get drunk, I want Genuine, Double Rectified, Busthead Whiskey - Aged in the keg...shopping is a separate issue

then the cops were called to babysit the drunk guy but they didn't show up..well what do you expect..you can thank socialite Peter Lance and the News-Press for sucking the mojo outta the drunk driving team

so why would they show up for a stationary drunk?

in China they are having the Yulin Dog Meat Festival and you know what that means..HOT DOGS!! and remember it was a Chinaman who tortured and killed little dog Davey...so should we bar all Chinamen from entering the US?? YES....Chinese women are cool, though

I was curious as to how the Chinese go about procuring, killing, cooking then eating the mutts...apparently, they have an outdoor market where the dogs are caged sorta like a lobster tank where you pick the one you wanna eat..then they plop it into boiling water and the poor lobster turns red having been boiled to death...

the Sedgwick Reserve in Santa Ynez is related to Edie Sedgwick...the pretty girl from Santa Barbara who wound up a little star and Andy Warhol's pal and Bob Dylan wrote 'Just Like a Woman' about her...the family was crazy and the whole story is fascinating.. I traveled among people in that circle for awhile, but it wasn't very healthy.. I do have weakness for free-spirited yet troubled beautiful  blonde chicks... and Edie was just like stunning

of course I'm concerned the Land Trust may have some fancy ideas about "restoration"....and of course of course the dog issue...I fear it may just be another dog park...it is essential that this area be left as it is because it is perfect
